Information:
Following the entry into force on 25.05.2018 of EU Regulation no. 679/2016 regarding the protection of natural persons with regard to the processing of personal data and regarding the free movement of such data (General Data Protection Regulation — G.D.P.R.), we inform you that S. CARFIL S.A. Brașov will align itself with the standards imposed by the European forum.
The main purpose of this regulation is to increase the level of protection of personal data and create a climate of trust and transparency, which allows each person to control their own data. This regulation is the legal basis for data processing.
Personal data:
Personal data (“Personal Data”): means any information about an identified or identifiable natural person. An identifiable natural person is a person who can be identified directly or indirectly, in particular by reference to an identification element, such as: name, surname, identification number (C.I.M. number), location data (domicile/residence address, electronic address) or to one or more specific elements, such as: CNP, identity card series and number, citizenship, sex, date and place of birth, marital status, military status, signature, profession, salary rights, studies, professional qualifications and specializations, workplace, references regarding professional activity, professional development, administrative/disciplinary investigation, sanctions, accidents at work, legal record, tax deduction, account and bank card data, data and information for family members, medical data and information, duration of rest leave/ medical leave/ leave without pay, retirement file, court decisions and other data or information specific to his physical, physiological, genetic identity, psychological, economic, cultural or social.
Data operator:
Operator of personal data: S. CARFIL S.A. Brasov based in Mun. Brașov County Brașov, Str. Zizin no. 119, Postal code 500407 No. Trade Register J 8./596/2001, CUI RO 13945863.
Processing personal data means collecting, recording, organizing, structuring, storing, adapting or modifying, extracting, consulting, using, disclosing by transmission, disseminating or otherwise making available, aligning or combining, restricting, erasing or destroying.
Dates:
The personal data are:
– processed legally, fairly and transparently towards the data subject;
– collected for specific, explicit and legitimate purposes and are not subsequently processed in a manner incompatible with these purposes;
– adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed;
– kept in a form that allows the identification of the persons concerned for a period of time that does not exceed the period necessary to fulfill the purposes;
– processed in a way that ensures their adequate security.
The person concerned is any employee of S. CARFIL S.A. Brașov.
Purpose:
The purpose of processing is the legal basis that regulates activities related to:
– administration, records and management of human resources;
– payment of salary rights, social contributions, tax, financial claims/debts for the person concerned,
– analysis and statistics;
– data transfer to a third party or proxy with whom the operator has contractual relations, collaborative relations or to a recipient, to whom the operator is obliged by law to process and communicate this data (judicial bodies, courts, authorities, bodies and public institutions).
Duration:
The duration of the processing is both the duration of the validity of the individual employment contract and after the termination of the individual employment contract, in compliance with the provisions in force of the labor legislation and the legislation regarding the security of data processing and storage/archiving.
Rights:
The rights of the natural person concerned are:
– the right to be informed about the personal data processed by the data operator;
– the right of access to the categories of personal data and to the method of their processing;
– the right to data portability: the right to receive data in a structured format and the right to transmit this data to another operator/authorized/third party/recipient;
– the right to opposition: the right to oppose the processing of certain categories of personal data or a certain purpose of the processing for a certain period of time; this right is not permanent;
– the right to rectification: the right to correct the inaccurate/erroneous content of certain personal data;
– the right to delete personal data: the right to request the deletion of some personal data (in case of finding that there is no legal basis, disappearance of the purpose of collection and/or processing, opposition to collection and/or processing, expiration of the retention period stipulated by law and others);
– the right to restrict processing: the right to request the interruption of processing for a certain period of time and/or in a certain department/compartment;
– the right to file a complaint with the National Authority for the Supervision of the Processing of Personal Data (A.N.S.P.D.C.P.).
These rights can be exercised through a written request, signed and dated, sent to the management of S. CARFIL S.A. Brașov.
